ยง 5.89.1 Executive Order-No. 89.1: Extending the Period for Paying Real Property Taxes Without Interest in Certain School Districts, Due to a Disaster Emergency

WHEREAS, beginning on September 7, 1998 and continuing, severe thunderstorms with high winds and significant rain came through New York State and caused widespread power outages and disrupted vital public transportation and public safety systems within Cayuga, Fulton, Madison, Monroe, Montgomery, Oneida, Onondaga, Oswego and Wayne Counties and contiguous areas;

WHEREAS, this event resulted in personal hardship and damage to residential and commercial property, and it continues to pose a threat to the public health and safety;

WHEREAS, by Executive Order Number 88 I declared a State Disaster Emergency in the affected counties, and directed State agencies to respond as necessary to assist those affected counties in restoring vital public transportation systems and to provide such other assistance as necessary to protect the public health and safety;

WHEREAS, real property taxes for the 1998-1999 school year are currently due in the affected counties;

WHEREAS, by virtue of section 1322 of the Real Property Tax Law, the date by which such taxes would have been payable without interest is on or about September 30, 1998;

WHEREAS, such taxes would normally be subject to interest if paid after that date;

WHEREAS, section 925-a (2) of the Real Property Tax Law, as added by Chapter 389 of the Laws of 1997, authorizes the Governor to issue an Executive Order during a State Disaster Emergency, extending the period for paying real property taxes without interest by up to seven days in a county, city, town, village or school district in the affected area, if the Chief Executive Officer of the county, city, town, village, or school district requests such an extension;

WHEREAS, a request for such an extension was received from the Chief Executive Officer of the East Syracuse-Minoa Central School District, Jordan Elbridge Central School District, Weedsport Central School District, Liverpool Central School District, North Syracuse Central School District, Fayetteville-Manlius School District, Lyncourt Union Free School District, Baldwinsville Central School District, Central Square Central Schools, Chittenango Central Schools, LaFayette Central School District, Morrisville-Eaton Central School System, Sherburne-Earlville Central School District, Stockbridge Valley Central School District, Clinton Central School District, New Hartford Central School District, New York Mills Union Free School District, Remsen Central School District, Vernon Verona Sherrill Central School District, Waterville Central School District, Town of Webb Union Free School District and Gloversville Enlarged School District; and

WHEREAS, given the hardships facing the people of Cayuga, Fulton, Madison, Monroe, Montgomery, Oneida, Onondaga, Oswego and Wayne Counties and contiguous areas as a result of the September 7, 1998 storm, such an extension is warranted;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, pursuant to section 925-a (2) of the Real Property Tax Law, do hereby extend by seven days the period for paying without interest the real property taxes for the 1998-1999 school year that are currently due in the East Syracuse-Minoa Central School District, Jordan Elbridge Central School District, Weedsport Central School District, Liverpool Central School District, North Syracuse Central School District, Fayetteville-Manlius School District, Lyncourt Union Free School District, Baldwinsville Central School District, Central Square Central Schools, Chittenango Central Schools, LaFayette Central School District, Morrisville-Eaton Central School System, Sherburne-Earlville Central School District, Stockbridge Valley Central School District, Clinton Central School District, New Hartford Central School District, New York Mills Union Free School District, Remsen Central School District, Vernon Verona Sherrill Central School District, Waterville Central School District, Town of Webb Union Free School District and Gloversville Enlarged School District so that such taxes shall be payable without interest up to and including the seventh day after the date that said taxes would otherwise be due without interest; and

FURTHER, by virtue of the same section 925-a (2) of the Real Property Tax Law, any taxes not paid by such date shall be subject to the same penalties and interest that would have applied if no such extension had been granted.

Executive Order No. 89 dated September 24, 1998 is superceded by this Executive Order. Signed: George E. Pataki
